Manual of Good Practice for the prosecution of crimes against Intellectual Property
The Ministry of Culture has a Manual of Practice for the prosecution of crimes against intellectual property , developed with the collaboration of a number of entities and organizations that represent and protect the rights of creators.
The Manual is divided into two sections:
In the first, analyzes the state of intellectual property and piracy in Spain through a series of statistics and reports provided by the Security Forces of the State, the Attorney General and Ministry of Culture itself. It presents the Government's Comprehensive Plan for the reduction and elimination of activities infringing intellectual property, explaining the different measures of cooperation, prevention, awareness and training policy to be developed.
In the second, the report proposes a series of good practice for the prosecution of crimes against intellectual property:
- Performance of Security Forces: Cooperation and coordination between the Security Forces; guidelines for the investigation of the facts; Expertise, sample storage and destruction of effects Diligence rights information to the victim or injured party and offer actions, and investigation of organized crime.
- Processing of legal proceedings: quick trials for the crime; report; Destination of instruments and effects of crime; precautionary measures, and procedural performance management entities.
- International cooperation: international police cooperation, judicial cooperation international institutions to support international judicial cooperation, and support tools for international judicial cooperation.
This manual is a text recommended reading for anyone interested in intellectual property protection and culture in general.
